Commission Meeting

MEETING AGENDA

The New Jersey Law Revision Commission is continuing to comply with changes to New Jersey’s Senator Byron M. Baer Open Public Meetings Act, Executive Orders issued by the Governor of the State of New Jersey, and recommendations issued by the Center for Disease Control and Prevention (CDC) regarding “social distancing.” 

As a result, the November meeting of the New Jersey Law Revision Commission will be conducted remotely on Thursday, November 19, 2020, at 1:00 p.m. 

Any member of the public who wishes to submit comments on any agenda item, or to participate in the meeting, should contact Laura C. Tharney in advance of the start time of the meeting, at: lct@njlrc.org

 

1. Confinement - Consideration of a Revised Draft Tentative Report proposing changes to clarify the meaning of “confinement” in New Jersey’s persistent offender statute, N.J.S. 2C:44-3(a), as discussed in State v. Clarity, 454 N.J. Super. 603 (App. Div. 2018). Report

4. Parentage - Consideration of a Revised Draft Tentative Report incorporating the guidance provided by the Commission in this area so far, and proposing revisions to the New Jersey Parentage Act (N.J.S. 9:17-38 et seq.). Report

2. Child Endangerment - Consideration of a Draft Tentative Report proposing clarification of the standard of harm required to convict a defendant pursuant to N.J.S. 2C:24-4(a) as a result of the New Jersey Supreme Court decision in State v. Fuqua, 234 N.J. 583 (2018). Report

3. Citizen’s Arrest - Consideration of a Draft Tentative Report proposing the modification or repeal of three statutes (N.J.S. 2A:169-3; N.J.S. 2C:20-11; and, N.J.S. 2C:20-14) authorizing the arrest of another by a private citizen, as well as the elimination of references to “special officer” in various statutes. 5. Contempt Charges for Violations of Conditions of Pre-Trial Release - Consideration of a Memorandum proposing a project to determine whether or not it would be useful to modify N.J.S. 2A:162-24 to clarify that criminal contempt charges are not available for violations of conditions of pre-trial release except for violations of no-contact orders pursuant to the holding of State v. McCray, 243 N.J. 196 (2020). Memo

6. Household Member - Consideration of a Memorandum proposing a project to clarify the scope of the term “household members” as used in the Prevention of Domestic Violence Act (PDVA) based on the decision in E.S. v. C.D., 460 N.J. Super. 326 (Ch. Div. 2018). Memo

7. Spill Compensation and Control Act - Consideration of a Memorandum recommending the conclusion of the Commission’s preliminary work in this area. Memo
