Commission Meeting

The New Jersey Law Revision Commission is continuing to comply with changes to New Jersey’s Senator Byron M. Baer Open Public Meetings Act, Executive Orders issued by the Governor of the State of New Jersey, and recommendations issued by the Center for Disease Control and Prevention (CDC) regarding “social distancing.” 

As a result, the September meeting of the New Jersey Law Revision Commission will be conducted remotely on Wednesday, September 16, 2020, at 4:30 p.m.

MEETING AGENDA

1.     Kidnapping – Consideration of a Revised Draft Tentative Report proposing changes to clarify the “unharmed release” provision of New Jersey’s kidnapping statute, N.J.S. 2C:13-1(c)(1) as discussed in State v. Sherman, 367 N.J. Super. 324 (App Div. 2004) and State v. Nunez-Mosquea, 2017 WL 3623378 (App. Div. Aug. 24, 2017). Report

2.     Traumatic Event - Consideration of a revised Draft Tentative Report, containing updated drafting in the Appendix, proposing clarification of the term “traumatic event” as used in the accidental disability retirement statute, N.J.S. 43:16A-7. Report

3.     Parentage - Consideration of a Draft Tentative Report proposing modifications to the New Jersey Parentage Act, N.J.S. 9:17-38 et seq. Report Update Memo

4.     Citizen’s Arrest - Consideration of a Memorandum proposing a project to recommend modification or repeal of three statutes (N.J.S. 2A:169-3; N.J.S. 2C:20-11; and, N.J.S. 2C:20-14) authorizing the arrest of another by a private citizen. Memo

5.     Meaning of “Necessary” in the Context of Eminent Domain and Condemnation - Consideration of a Memorandum proposing a project to clarify the term “necessary” within the context of redevelopment projects, specifically the Local Redevelopment and Housing Law statute N.J.S. 40A:12A-8(c), as discussed in Borough of Glassboro v. Grossman, 457 N.J. 416 Super. (App. Div. 2019). Memo

6.     Workers’ Compensation Act & Auto Insurance Recovery Cost Act - Consideration of a Memorandum proposing a project to clarify N.J.S. 39:6A-6 to address workers’ compensation carriers’ recovery of economic losses under N.J.S. 34:15-40 pursuant to the holding in N.J. Transit Corp. v. Sanchez , 242 N.J. 78 (2020). Memo

7.     Indemnity - Consideration of a Memorandum, updated to reflect recent case law, proposing a project to clarify the statutes pertaining to the defense or indemnification of State and County employees in legal actions (N.J.S. 59:10A-1 and N.J.S. 40A:14-117) as discussed in Kaminskas v. Office of the Attorney General, 236 N.J. 415 (2019). Memo

8.     Remarriage - Consideration of an Update Memorandum regarding additional research performed on the issue of retroactive application of 2014 amendments to the alimony statute (N.J.S. 2A:34-23) and seeking Commission guidance. Memo
