MEETING AGENDA

The New Jersey Law Revision Commission is continuing to comply with changes to New Jersey’s Senator Byron M. Baer Open Public Meetings Act, Executive Orders issued by the Governor of the State of New Jersey, and recommendations issued by the Center for Disease Control and Prevention (CDC) regarding “social distancing.” 

As a result, the February meeting of the New Jersey Law Revision Commission will be conducted remotely on Thursday, February 18, 2021, at 4:30 p.m. 

Any member of the public who wishes to submit comments on any agenda item, or to participate in the meeting, should contact Laura C. Tharney in advance of the start time of the meeting, at: lct@njlrc.org

1. Child Endangerment – Consideration of a Draft Final Report proposing clarification of the standard of harm required to convict a defendant pursuant to N.J.S. 2C:24-4(a) in response to the New Jersey Supreme Court decision in State v. Fuqua, 234 N.J. 583 (2018). Report

 2. Confinement - Consideration of a Draft Final Report proposing changes to clarify the meaning of “confinement” in the New Jersey’s persistent offender statute, N.J.S. 2C:44-3(a) as discussed in State v. Clarity, 454 N.J. Super. 603 (App. Div. 2018). Report

 3. PLIGAA – Consideration of a Draft Final Report recommending the conclusion of the Commission’s work in this area without a recommendation. Report

 4. Inhabitant – Consideration of a Memorandum proposing a project to clarify the use of the term “inhabitant” in New Jersey’s Law Against Discrimination N.J.S. §§ 10:5-1 et seq. as discussed in Calabotta v. Phibro Animal Health Corp., 460 N.J. Super. 38 (App. Div. 2019). Memo

School District of Residence - Consideration of a Revised Draft Tentative Report proposing modification of N.J.S. 18A:36A-12 and N.J.S. 18A:36C-7.1 to define the term “school district of domicile” as discussed in Bd. of Educ. of Twp. of Piscataway v. New Jersey Dept. of Educ., 2019 WL 2402545 (App. Div. 2019). Report

Household Member - PDVA - Consideration of a Draft Tentative Report proposing replacement of the term “household member” in the Prevention of Domestic Violence Act with updated language that would provide protection to victims of domestic violence from those with whom they reside or resided in the past (See, E.S. v. C.D., 460 N.J. Super. 326 (Ch. Div. 2018)).  Report 50 State Survey

Unemployment Benefits – Consideration of a Draft Tentative Report concerning payment of unemployment benefits to an employee scheduled to start a new job but who could not because the offer of new employment was rescinded, as discussed in McClain v. Bd. of Review, Dep't of Labor, 237 N.J. 445 (2019). Report

 8. Uniform Faithful Presidential Electors Act (UFPEA) – Consideration of a Draft Tentative Report recommending enactment of the Uniform Act in New Jersey as modified to address New Jersey’s existing law. Report
