The New Jersey Law Revision Commission will meet on Thursday, February 20, 2020, at 4:30 p.m. in the Commission offices on the 7th Floor, 153 Halsey Street, Newark, New Jersey

 

1.  Standard Form Contracts – Consideration of a Revised Draft Final Report, a Memorandum explaining the changes made in response to comments received, and a Memorandum containing collected comments received regarding the project organized by issue.    Report Memo MemoCollectedIssues

2.  Meaning of “Physical Examination” – Consideration of a Revised Draft Final Report proposing three options to clarify the term “physical examination” for purposes of the New Jersey’s Tort Claims Act (N.J.S. 59:6-4).    Report

3.  Clarification of Tenure – Consideration of a Revised Draft Final Report containing a modest change in response to comments received on the day of the last Commission meeting, after it was released as a Final Report.    Report

4. Local Lands and Building Laws – Bidding - Consideration of a Draft Tentative Report proposing a modification to the Local Land and Building Law, specifically, N.J.S. 40A:12-5(a)(3), to clarify that the acquisition of real property, capital improvement, or personal property by a County or municipality is subject to the Local Public Contracts Law (N.J.S. 40A:11-1 et seq.).    Report

5.  Satisfactory Completion of Probation – Consideration of a Draft Tentative Report proposing a clarification of the phrase “satisfactory completion” of probation for purposes of New Jersey Code of Criminal Justice (N.J.S. 2C:52-2).    Report

6. Inmate Call Services - Consideration of a Memorandum proposing a project to modify the language of N.J.S. 30:4-8.12 to address “infrastructure costs” as discussed in Securus Tech., Inc. v. Murphy, 2019 WL 1244802 (App. Div. Mar. 18, 2019).    Memo

7. Towing Act - Consideration of a Memorandum proposing a project to clarify whether a litigant must exhaust administrative remedies before filing suit against a towing company pursuant to N.J.S. 56:13-21 as discussed in Pisack v. B & C Towing, Inc., 455 N.J. Super. 225 (App. Div. 2018).    Memo

8.  2019 Annual Report – Consideration of the Draft Annual Report for 2019.
