1. Standard of Proof for Alcohol Test Refusal Offenses in N.J.S.A. 39:4-50.4a – Consideration of a Draft Final Report recommending the elimination of any reference to the burden of proof from N.J.S.A. 39:4-50.a in light of the holding in State v. Cummings, 184 N.J. 84 (2005).  Report 

2.  Cognizable Child Sexual Abuse Act (“CSAA”) and Child Victims Act (“CVA”) Claims – Consideration of a Memorandum proposing a project addressing whether N.J.S.A. 2A:61B-1(a)(1) of the CSAA and N.J.S.A. 2A:14-2b(a) of the CVA would benefit from modifications consistent with the holdings of Doe v. Estate of C.V.O., 477 N.J. Super. 42 (App. Div. 2023).  Memo

Unconstitutional Provisions Relating to Recall of Federal Officials under N.J.S.A. 19:27A–1 to 18- Consideration of a Memorandum proposing a project to address the constitutionality of N.J.S.A. 19:27A–1 to 18, portions of which were held unconstitutional in Comm. to Recall Robert Menendez From the Office of U.S. Senator v. Wells, 204 N.J. 79 (2010).  Memo

4. “Clean Slate” Statute (N.J.S.A. 2C:52-5.3) Application to Out-of-State Convictions – Consideration of a Memorandum proposing a project addressing the application of the “clean slate” statute in N.J.S.A. 2C:52-5.3 to out-of-state convictions when determining eligibility for expungement, as discussed in In re K.M.G., 477 N.J. Super. 167 (App. Div. 2023).  Memo

5. Statutory References to the New Jersey Administrative Code – Consideration of a Memorandum summarizing how New Jersey statutes refer to New Jersey Administrative Code provisions and requesting guidance from the Commission on the appropriate protocol moving forward. Memo

A Tradition of Law Revision, 1987 - Present

With the enactment of N.J.S. 1:12A-1 et seq., the current New Jersey Law Revision Commission was created in 1985 and began work in 1987.

The New Jersey Law Revision Commission is required by statute to “promote and encourage the clarification and simplification of the law…and its better adaptation to present social needs, secure the better administration of justice and carry on scholarly legal research and work.” N.J.S. 1:12A-8.

The Commission does so by conducting an ongoing review of New Jersey statutes and case law to identify areas of the law that require revision. The Commission also considers recommendations from the American Law Institute, the Uniform Law Commission (formerly the National Conference of Commissioners on Uniform State Laws) and other learned bodies as well as members of the legal community and the public.
