1. Use of the Term “Maiden Name” in New Jersey Statutes – Consideration of a Draft Final Report recommending the replacement of the term “maiden name” in New Jersey’s statutes with updated language.  Report

2. Standard of Proof for Alcohol Test Refusal Offenses in N.J.S. 39:4-50.4a – Consideration of a Draft Tentative Report clarifying the constitutional standard of proof for refusal to submit to alcohol test offenses in N.J.S. 39:4-50.4a, as held by the New Jersey Supreme Court in State v. Cummings, 184 N.J. 84 (2005).  Report

3. Child Endangerment Statute Regarding Impairing or Debauching the Morals of a Child in N.J.S. 2C:24-4(a)(1) – Consideration of an Update Memorandum summarizing comments received after the release of the Tentative Report concerning the phrase “impairing or debauching the morals of a child” (N.J.S. 2C:24-4(a)(1)) as discussed in State v. Johnson, 460 N.J. Super. 481 (Law Div. 2019) and recent developments impacting N.J.S. 2C:24-4.  Memo

Title 39: Windshield Statute (N.J.S. 39:3-74) – Window Tint Traffic Stops/Citations – Consideration of an Update Memorandum summarizing window tint law in New Jersey and throughout the United States, and seeking Commission guidance regarding further research and outreach in this area.  Memo   50 State Survey

5. Employment Preference for New Jersey Residents on Public Works in N.J.S. 34:9 – Consideration of a Memorandum proposing a project to address the constitutionality of N.J.S. 34:9-2, which was held unconstitutional as a violation of the Privileges and Immunities Clause of the Constitution in Neshaminy Constructors, Inc. v. Krause, 181 N.J. Super. 376 (Ch. Div. 1981), modified, 187 N.J. Super. 174 (App. Div. 1982).  Memo

We are pleased to announce that Andrew Galligan from Rutgers-Newark and Nivu Srinivasan from Seton Hall University will be joining the New Jersey Law Revision Commission as Legislative Law Clerks for the Summer.

 New Jersey Law Revision Commission – Executive Director position

The New Jersey Law Revision Commission, an independent legislative commission (N.J.S. 1:12A-1 et seq.), is seeking an Executive Director with the vision and commitment to enhance the capacity and impact of the LRC. Applicants should be experienced, NJ-licensed attorneys in good standing, with a background including management/supervision. Must reside in NJ. Position requires engagement with members of the Legislature, other State entities, and members of the public, as well as the operation of the Commission’s office, which consists of staff members focused on detailed legal research and writing to support recommendations for statutory revision. This State position is full-time, and work is done on-site in the NJLRC’s Newark office. The annual salary is $122K and the position also provides State benefits, including health insurance and enrollment in the pension system.

A Tradition of Law Revision, 1987 - Present

With the enactment of N.J.S. 1:12A-1 et seq., the current New Jersey Law Revision Commission was created in 1985 and began work in 1987.

The New Jersey Law Revision Commission is required by statute to “promote and encourage the clarification and simplification of the law…and its better adaptation to present social needs, secure the better administration of justice and carry on scholarly legal research and work.” N.J.S. 1:12A-8.

The Commission does so by conducting an ongoing review of New Jersey statutes and case law to identify areas of the law that require revision. The Commission also considers recommendations from the American Law Institute, the Uniform Law Commission (formerly the National Conference of Commissioners on Uniform State Laws) and other learned bodies as well as members of the legal community and the public.

The Tentative Reports below are distributed to advise interested persons of the NJLRC's tentative recommendations and to offer an opportunity to submit comments. The Commission is actively seeking comments on the reports below.
